WARRANTY
Equal Optics offers a lifetime warranty for its hardware products, which can only be claimed by the original end-user when purchased from an authorized reseller or directly from Equal Optics. The warranty covers defects in material and workmanship that affect the form, fit, and function of the products and ensures that they will work as specified. If a defect is found, Equal Optics may repair, replace, or issue a credit or refund for the product. However, the warranty does not cover failure or defects resulting from misuse, abuse, alteration, or improper installation or usage not in accordance with product instructions. All Equal Optics parts have a 10-year serviceable lifetime warranty, unless specified otherwise.
Equal Optics agrees to provide advance replacements for any defective items. Equal Optics will, within twenty-four (24) hours of being notified by Customer of a suspected Equipment defect, use its commercially reasonable best efforts to (i) attempt to resolve the problems through troubleshooting, and (ii) for any Equipment determined, in Equal Optics sole discretion, to be defective, ship suitable replacement Equipment to Customer via expedited delivery service. Customer must return the defective Equipment to Equal Optics within fourteen (14) days of receipt of the replacement Equipment.

Limitations of Remedies and Liability
The cumulative liability of Equal Optics to Customer for all claims relating to any item of Equipment (including, without limitation, the warranty provided) shall be limited to the total amount paid by Customer for such Equipment. In no event shall Equal Optics be liable for any consequential, indirect, special or incidental damages (including, without limitation, damages for loss of business profits, business interruption or other pecuniary loss), whether arising out of contract, tort, warranty or otherwise, even if Equal Optics has been advised or is otherwise aware of the possibility of such potential loss or damage. The foregoing limitation of liability shall apply regardless of the success or effectiveness of other remedies. Customer acknowledges that the price charged for the Equipment has been agreed to by Equal Optics in reliance on the allocation of risk and limitation of liability set forth herein.
Equal Optics is not responsible for any damages or injuries resulting from the use of our products as critical components in life support devices or systems. Additionally, our products are not intended for use in such devices or systems, and we make no representation or warranty as to their fitness for such purpose. By using our products, Customer agrees to not hold our company liable for any damages or injuries arising from the use of our products in life support devices or systems.
THE FOREGOING EXPRESS WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN LIEU OF ANY OTHER WARRANTIES OR REMEDIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTIES OR INDEMNITIES AGAINST INTELLECTUAL PROPERTY INFRINGEMENT.
